TERMS AND CONDITIONS OF THE ONLINE STORE MDOTM.PL


1. General Provisions

This online store (“Store”) is operated at the web address www.mdotm.pl by Zbigniew Majkowski, conducting business under the name P.P.H.U. Majkowski, ul. Zygmuntowska 10a, 05-270 Marki, NIP: 1250084257 (“Seller”). The Seller can be contacted at the above address or via email at MdotM.leathercraft@gmail.com.

These terms and conditions (“Terms and Conditions”) define the rules for using the Store, particularly the process for placing and fulfilling orders, and the rights and obligations of the Seller and individuals placing orders or interested in purchasing products in the Store (“Buyers”).

The Store offers services provided electronically, particularly the ability to place orders in the store and to conclude sales contracts for physical products available in the Store (“Products”).

Using the Store does not require any special technical conditions from the Buyer. Specifically, the Buyer needs a device with internet access and a web browser capable of opening the Store's website, enabling cookies, and an active email address to complete orders in the Store.

While using the Store, including placing and processing orders, any actions that may violate the law are prohibited, particularly submitting unlawful content via forms available in the Store.

 
2. Using the Store and Placing Orders

The Store allows Buyers to browse the Products offered by the Seller and to place orders for those Products as outlined in these Terms and Conditions and directly on the Store’s website. Registration and creating an account are not required to browse the Store or place orders.

Orders are placed by adding Products of interest to the cart from the Store's website, then completing the order form in the “cart” section, selecting a payment and delivery method, and paying for the placed order.

To fulfill the order, it is necessary to provide accurate, complete, and up-to-date information as specified in the order form. The Seller reserves the right to suspend the fulfillment of an order if the Buyer provides false information or if there are reasonable doubts about the accuracy of the provided information.

All prices listed in the Store are gross prices. The total cost of the order includes the price of the Products and any additional costs, particularly delivery fees added to the final price. The Buyer is informed of the total order price when placing the order in the Store.

Placing an order in the Store is equivalent to accepting these Terms and Conditions and the Store's privacy policy, which the Buyer additionally confirms when completing the order form. In case of any doubts regarding the terms, the Buyer can contact the Seller.

The available delivery methods and payment options are described on the Store's website and presented to the Buyer during the order process.

A valid order and the conclusion of a sales contract between the parties occur when the Buyer completes their information, selects a delivery and payment method, and fully pays for the order. The Buyer receives an order confirmation to the email address provided.

The Seller fulfills the order by gathering the ordered Products, packaging them for delivery to the Buyer, and dispatching the package in accordance with the selected delivery method.

The Seller processes the order as quickly as possible, in any case no later than 30 days from the date the order is placed and paid for. When placing an order, the Buyer is informed about the estimated time for order processing and delivery. These timeframes are approximate and not binding on the Seller, but efforts will be made to complete the order as quickly as possible, especially considering the aforementioned delivery time.


3. Payments and Delivery

The available payment methods for orders placed by the Buyer are described on the website. Payments are made primarily via electronic transfers through Przelewy24.

At the time of placing the order, the Buyer can request an invoice, which will be sent electronically to the email address provided in the order form.

The available delivery methods are described on the Store's website. Delivery is provided through InPost parcel lockers, InPost courier, Polish Post, or DPD courier.

The Buyer bears the cost of product delivery unless otherwise specified by the Seller on the Store’s website. The order is considered fulfilled when the Seller dispatches the package to the Buyer.


4. Complaints

The Seller guarantees that the Products sold in the Store are free of defects and is liable to the Buyer if the sold Product has a physical or legal defect (warranty for defects). The Seller’s liability in this regard is governed by the general provisions of the Civil Code.

If the Buyer believes that the sold Product is defective, they can file a complaint with the Seller. Complaints can be submitted in writing or electronically, using the contact details provided in section 1 of these Terms and Conditions. The complaint should include at least the complainant’s details (name, correspondence address, email address, and phone number), a description and reason for the complaint, and the content of the claim, the order number or other details to identify the order, and, if applicable, proof of purchase (e.g., an issued invoice). When filing a complaint, the Buyer is required to return the Products to the address indicated by the Seller.

The Seller will respond to the Buyer’s complaint within 14 days of receiving it via the same communication method used for submitting the complaint.


5. Right to Withdraw from the Contract

The Buyer, who is a natural person not conducting business activity or placing an order related to their business activity but where the contract’s subject does not constitute a professional nature for that person, particularly as it relates to the business activity’s object, has the right to withdraw from the contract without giving reasons within 14 days from the day they take possession of the purchased Products.

To withdraw from the contract, the Buyer must inform the Seller of their decision by providing a clear statement, for example, via letter, fax, or email. Upon request, the Seller will provide a withdrawal form.

To meet the withdrawal deadline, it is sufficient for the Buyer to send the withdrawal notice before the expiration of the withdrawal period.

The Buyer must return the Products to the Seller or hand them over to a person authorized by the Seller to collect them immediately, but no later than 14 days from the day the Buyer withdraws from the contract, unless the Seller offers to collect the Products. The deadline is met if the Buyer sends the Products before the 14-day period expires. The Buyer bears the direct costs of returning the Products.

In case of a successful withdrawal, the contract is considered null, and the Seller refunds all payments received from the Buyer, including the lowest available delivery cost in the Store (if the Buyer covered this cost), immediately and in any event no later than 14 days from the day the returned Products were received. The refund will be made using the same payment methods as used by the Buyer in the original transaction, unless otherwise agreed between the parties.


6. Intellectual Property Rights

All content in the Store and on the Seller’s website, including Products, names, logos, digital content, and textual, graphical, and photographic materials, are the exclusive property of the Seller and are legally protected, particularly by copyright or industrial property law.

Making a purchase and fulfilling an order does not, in any way, transfer intellectual property rights to the Buyer or grant a license to such rights. In all cases, the Buyer is obliged to respect and not violate the Seller’s rights, particularly by not copying any content or Products.


7. Personal Data

As part of the services provided electronically by the Seller and in connection with accepting and processing orders or additional actions related to orders, the Seller will process the Buyer’s personal data under the conditions outlined in the Store’s privacy policy and respecting the Buyer’s rights.


8. Seller’s Liability

Regarding the acceptance and fulfillment of orders and product sales, the Seller is liable to the Buyer under general principles, particularly under the warranty for product defects. In any case of the Seller’s liability, its value is limited to the total value of the order concerned.

The Seller makes every effort to ensure the Store, its website, and the entire order processing and delivery process runs smoothly and without issues. However, the Seller is not responsible for the actions of intermediaries (including payment and delivery services) or for errors, omissions, and complications caused by the improper functioning of electronic devices, the internet, etc.


9. Out-of-Court Dispute Resolution

The Buyer may use out-of-court methods for handling complaints and pursuing claims. Specifically, the Buyer can:

- request a resolution of the dispute arising from the concluded contract from a permanent consumer arbitration court,- submit a request to the provincial inspector of the Trade Inspection to initiate mediation proceedings to resolve the dispute amicably between the Buyer and the Seller,- seek assistance from the district (municipal) consumer rights ombudsman or a social organization whose statutory tasks include consumer protection.

The Buyer may also use the ODR platform available at http://ec.europa.eu/consumers/odr. The platform is used to resolve disputes between consumers and traders related to out-of-court settlement of disputes regarding contractual obligations arising from online sales or service contracts.

10. Final Provisions

The Seller reserves the right to modify these Terms and Conditions at any time for important reasons, such as changes in the Seller's or Store’s business profile or scope, legal or tax changes, or significant economic or social changes. Contracts concluded before any changes will be governed by the Terms and Conditions applicable at the time the contract was concluded. The Seller may add, modify, or remove functions in the Store.

The Seller also reserves the right to make changes regarding the assortment, prices, product availability, appearance, and Store functions at any time and at their sole discretion. The Seller has the right to introduce or cancel
